Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cropwyse mobile application, website at cropwyse.com, and related services (collectively, the "Service") operated by Cropwyse ("Cropwyse," "we," "us," or "our").

By creating an account, downloading, or using Cropwyse, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Cropwyse. If you are under 18, you represent that you have permission from a parent or legal guardian. You must provide accurate account information and keep it up to date.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• Notify us promptly at cropwyse@gmail.com if you suspect unauthorized access
• We may suspend or terminate accounts that violate these Terms or pose a security risk

3. Subscriptions and Payments

Cropwyse offers optional paid subscriptions ("Cropwyse Pro" or similar) with additional features. Subscriptions are billed through your Apple ID via the App Store.

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings after purchase
• Any free trial, if offered, converts to a paid subscription unless canceled before the trial ends
• Refunds are handled by Apple according to App Store policies

Prices may change with notice where required. Feature availability may vary by plan or region.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Post false, misleading, or fraudulent marketplace listings or community content
• Harass, abuse, threaten, or impersonate others
• Upload malware, spam, or content that infringes intellectual property or privacy rights
• Scrape, reverse engineer, or attempt to access the Service through unauthorized means
• Interfere with or disrupt the Service, servers, or networks
• Use the Service to provide professional agricultural, legal, medical, or financial advice to third parties without appropriate qualifications

5. User Content

You retain ownership of content you submit (such as harvest logs, photos, listings, posts, and profile information). By submitting content, you grant Cropwyse a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate and improve the Service.

You represent that you have the rights to submit your content and that it does not violate these Terms or the rights of others. We may remove content that violates these Terms or applicable law, but we are not obligated to monitor all user content.

6. Marketplace and Community

Cropwyse may allow users to list items for swap, sale, or other exchange and to interact with other gardeners. Cropwyse is a platform only — we do not guarantee listings, transactions, product quality, or user conduct. Any arrangement between users is solely between those users. Use caution and common sense when meeting or transacting with others.

7. AI and Gardening Information

Cropwyse provides planting calendars, weather data, tips, and AI-generated suggestions for informational purposes only. Garden outcomes depend on many factors outside our control. Cropwyse does not guarantee harvest results, plant health, or financial outcomes. Always use your own judgment and consult local experts when needed.

8. Intellectual Property

The Service, including its design, software, logos, plant data, and original content (excluding user content), is owned by Cropwyse or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except as allowed by these Terms or applicable law.

9. Third-Party Services

The Service integrates with third-party services (such as Apple, Google, Supabase, and weather providers). Your use of those services may be subject to separate terms and policies. We are not responsible for third-party services.

10. Termination

You may stop using Cropwyse at any time and delete your account in the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute provisions).

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROPWYSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Cropwyse from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the rights of others.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory local law applies. You agree to attempt to resolve disputes informally by contacting us first. If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and cancel any active subscription.
